Legislation to Combat Illegal Use of ATV'S in The City of Utica
MAYOR PALMIERI PROPOSES LEGISLATION TO COMBAT ILLEGAL USE OF ATV’s IN THE CITY OF UTICA
Mayor Robert Palmieri today announced he is proposing an ordinance which will enhance enforcement of ATV’s illegally operating within city limits.
The Mayor’s proposed ordinance would impose a $500 fine for anyone illegally operating an ATV within city limits, as well as confiscation of the ATV. In addition to the fines, the owner of the ATV must reimburse the city for the towing expense.
If an ATV is confiscated, an owner would have to pay a redemption fee of $2,500 to retrieve the ATV. If the owner does not claim the ATV after it’s been confiscated for 60 days, the proposed ordinance allows the city to put it up for auction.
The Mayor’s proposed legislation is in response to dozens of complaints by residents from all sections of the city stating the illegal use of ATV’s is dangerous and negatively impacts their quality of life.
Separate from the legislation, the Mayor and Police Chief Mark Williams are partnering with Mohawk Valley Crime Stoppers to offer a $100 reward to anyone who provides information leading to the confiscation of an ATV. Anyone who contacts Mohawk Valley Crime Stoppers, even those who seek a reward, can remain anonymous.

The lead sponsor of the legislation is Councilmembers Jack LoMedico and Frank DiBrango. The legislation will be formally introduced at the Common Council’s next meeting on May 19th.
Mayor Palmieri stated, “My office, along with UPD, receive calls about illegal ATV’s use on a regular basis. This proposed legislation was crafted to curtail this activity, and to give UPD the resources and enforcement it needs to substantively address this issue.”
Mayor Palmieri continued, “I thank Councilmembers LoMedico and DiBrango for their support as we will continue to work together to promote public safety and quality of life.”
Councilman LoMedico stated, “As a city, we need to do everything possible to promote public safety and not allow illegal ATV use to be a nuisance to our residents. I’m please to support this legislation as it will help prevent this activity and make our streets and parks safer and more enjoyable.”
Councilman DiBrango stated, “I have witnessed individuals driving recklessly in our city streets and parks. I am confident that this legislation will put a stop to person's illegally operating ATVs and other off-road vehicles within city limits.”
Police Chief Mark Williams stated, “ATV’s and other off-road vehicles pose safety hazards to the rider and other motorist, as well as causing neighborhood disruptions and property damage. They are not designed to be used on the road. The riders tend to be young and unskilled at navigating these off-road vehicles, which resulted in them being crashed into motor vehicles, buildings, fire hydrants and trees. Our residents can be a big help in reducing this activity by calling the Crime Stoppers confidential tip line. Tips that lead to the confiscation of the vehicles are eligible for a reward up to $100.”
