307 Lansing Street Area Variance

Pursuant to Section 2-29-32(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to construct a fence at the above referenced property.
The applicant is proposing to install a 6’ high solid vinyl fence in the front yard area of the home. The fence will be located approximately 2’-3’ from the inside edge of the sidewalk. In accordance with Section 2-29-185 of the Zoning Ordinance of the City of Utica, all solid fences measuring more than three feet high are prohibited in the front yard. The applicant will be required to receive an area variance for the installation of the 6’ solid vinyl fence.

434 Fiore Drive Area Variance

Pursuant to Section 2-29-32(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to construct a fence at the above referenced property.
The applicant is proposing to install a 6’ high solid fence in the front yard area of the home. In accordance with Section 2-29-126(e) of the Zoning Ordinance of the City of Utica, a corner lot has two front yard setbacks since the property fronts on two streets.
The fence will be installed in line with the front of the house and extend out toward Fairwood Drive and run parallel to the street to the rear of the property. The fence will not extend into the corner area of the property which will obstruct the visibility of traffic. In accordance with Section 2-29-185 of the Zoning Ordinance of the City of Utica, all solid fences measuring more than three feet high are prohibited in the front yard. The applicant will be required to receive an area variance for the installation of the 6’ solid fence.

935-937 Schuyler Street Use Variance

Pursuant to Section 2-29-32(d)(2) of the Zoning Ordinance of the City of Utica, the applicant is seeking a use variance in order to create a parking area at the above referenced property.
The applicant owns a 3-unit structure at 938-940 Schuyler Street which does not have parking available. The proposed location for a parking area to accommodate his tenants is across the street of this home and is 40’ x 100’.
In accordance with Section 2-29-7 of the Zoning Ordinance of the City of Utica, a parking area is defined as a section of a lot to be used for parking up to five vehicles to be used specifically as an accessory use; a use which is customarily incidental and subordinate to the principal use on a lot, and located on the same zoning lot, except where superficially provided. Since with parcel is not located on a lot contiguous with the primary structure, the applicant will need to receive a use variance for the proposed parking area.
The applicant has submitted a plan for five cars to be parked diagonally on the length of the lot.
