Pursuant to Section 2-29-32(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to erect a fence at the above referenced property.

 

The applicant is proposing to install a 6’ high privacy fence along the property line on Booth Street.  The property line is approximately 13’ from the edge of the pavement.  The fence will extend off the rear of the two-story section of the home perpendicular to Booth Street and run along Booth Street to the property line in the rear of the yard.  The fence will encompass the portion of the property on the side and rear of the house.  The applicant has stated that they recently purchased the home and would like to fence in their rear yard for safety for their children and their pets. 

 

In accordance with Section 2-29-185 of the Zoning Ordinance of the City of Utica, all solid fences measuring more than three feet high are prohibited in the front yard.  The applicant will be required to receive an area variance for the increased height of the fence since this property is considered to have two front yards because it is a corner lot.
