Please take notice that the City of Utica Zoning Board of Appeals will hold a Public Hearing on Tuesday, NOVEMBER 15, 2022 at 5:00 pm in the Common Council Chambers of Utica City Hall.

 According to Section 2-29-77 of the City of Utica Zoning Ordinance, with respect to an application for a variance, the clerk of the board shall send written notice to all owners of property within 200 feet of the exterior boundaries of the subject property.

 This letter shall serve as written notice of stated ordinance.

Pursuant to Section 2-29-32(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to construct an addition to the garage at the above referenced property.

 

The applicant is proposing to construct a 20’ x 6’ addition to the front of the garage to allow the homeowner to park two cars in the garage.  The addition will match the existing house and garage.  The proposed addition will remain in line with the existing house which is 5’ from the side property line. 

 

In accordance with Section 2-29-126(e)(5) of the Zoning Ordinance of the City of Utica, the minimum side yard setback is 20’ total both sides.  The applicant will only have 10’ (total) setbacks.  The applicant will be required to receive an area variance for the reduction in the side yard setback.

Pursuant to Section 2-29-32(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to install a fence at the above referenced property.

 

The applicant is proposing to replace the existing 4’ chain link fence with a 6’ high wood stockade fence.  The proposed fence will extend off the rear of the house, run parallel with Barzie Drive and encompass the perimeter of the rear yard area. 

 

The property is located on the corner of Lee Blvd. and Barzie Drive.  In accordance with Section 2-29-126(e) of the Zoning Ordinance of the City of Utica, a corner lot has two front yard setbacks since the property fronts on two streets.   

 

In accordance with Section 2-29-585 of the Zoning Ordinance of the City of Utica, all solid fences measuring more than three feet high are prohibited in the front yard.  The applicant will be required to receive an area variance for the installation of the 6’ solid fence.

Pursuant to Section 2-29-32(d)(2) of the Zoning Ordinance of the City of Utica, the applicant is seeking a use variance in order to construct a garage at the above referenced property.

 

The applicant is proposing to construct a new 20’ x 50’ (1040 sf) four (4) stall garage in the parking lot at 409 Broad Street.  This garage will accommodate the tenants at 412 Main Street.  The finishes on the garage will be consistent with the former industrial and warehouse buildings in the neighborhood.

 

In accordance with Section 2-29-585 of the Zoning Ordinance of the City of Utica, accessory structures are not permitted in a Central Business District.  Therefore, the applicant will be required to receive a use variance for the construction of the garage.

Pursuant to Section 2-29-32(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to install a fence at the above referenced property.

 

The applicant is proposing to install a 6’ high vinyl fence around the perimeter of the property with the exception of the corner which will be angled to eliminate any visibility issues.

Pursuant to Section 2-29-32(d)(1) of the Zoning Ordinance of the City of Utica, the applicant is seeking an area variance in order to install signage at the above referenced property.

 

The applicant is proposing to install three internally illuminated wall signs at above referenced property.  Two signs will be 2’ x 10’ (40sf) and one sign will be 48” x 241” (±80 sf). 

 

In accordance with Section 2-29-134 of the Zoning Ordinance of the City of Utica, the maximum square footage for wall signage in an Urban Mixed Use zoning district is 60 sf.  The applicant is proposing 120 sf, therefore, will be required to receive an area variance for the proposed signage
