Pursuant to City of Utica Zoning Code Section 2-29-312(c), the applicant is seeking Site Plan review of a plan to convert the current two-family home into a three-family (multi-family) residential building. The applicant/owner is proposing to convert the attic space into a third unit. He intends to add a second staircase for ingress and egress along with a bathroom and a kitchenette to serve the proposed one-bedroom unit. Sufficient space is available on site to satisfy the additional parking needs, according to the applicant.
In the Residential Mixed zoning district, this is a permitted use with Site Plan approval from the Planning Board; no public hearing is required.
The Planning Board denied this application at its November meeting because neither the applicant nor a representative were present at the meeting. Subsequent to the meeting, the applicant met with Planning staff and asked if the Board would reconsider. Planning staff advised the applicant that his application was lacking a number of items, including the application fee, detailed drawings of the interior improvements planned and a photograph or description of the available parking. As of December 11, that material had still not been provided to Planning staff.

According to the applicant, the new structure will have a front façade that matches the existing building in design and materials. The front porch and turret-like structure will be reconstructed, along with their detailing.
This project has been reviewed and approved by the City’s Scenic & Historic Preservation Commission, though Section 2-29-45(c) of the City’s zoning ordinance allows the Planning Board to “accept the approval, overrule a denial or modify the decision” of the Commission.
The Planning Board granted Preliminary Site Plan approval at its November meeting with Final Site Plan approval awaiting the completion of the coordinated review under SEQRA.
