In April 2022, the Planning Board granted Final Site Plan approval to the applicant’s plans to construct a new building on the aforementioned site.  However, neither the signed resolution nor the file show evidence that a Negative Declaration under the State’s Environmental Quality Review Act (SEQRA) was ever approved by the Planning Board.


At this time, New York State Department of Transportation has requested that SEQRA be formally completed as they are in the process of reviewing permit requests for modification of the access to the site from Oriskany Street West.  The applicant’s project is an Unlisted Action under SEQRA, which does not require coordinated review; an Environmental Assessment Form – short form had been submitted by the applicant previously.
